This agreement supplements the Terms & Conditions for independent drivers, owner-drivers and carriers using FCMD Connect. A fleet employee or contractor also remains subject to their logistics provider’s employment or service agreement.
1. Status and authority
Unless a separate written agreement says otherwise, an independent driver or carrier supplies transport services in their own business and is not an employee, agent or representative of FreightCMD. Nothing here removes rights that cannot lawfully be excluded.
2. Eligibility
- You must be legally entitled to work, drive and provide the accepted transport service.
- You must maintain genuine and current identity, licence, registration, revenue licence, insurance, inspection and permit records.
- You must immediately report expiry, suspension, accidents, unsafe vehicles or loss of authority.
3. Trips and cargo
Review the route, cargo, vehicle class, timing, price and special requirements before accepting. Do not accept cargo or a trip you cannot lawfully or safely carry. Follow the recorded trip stages and obtain pickup, custody and delivery evidence honestly.
4. Safety and conduct
Obey road, working-time, dangerous-goods and loading rules; never interact with the app while driving; secure cargo; and treat clients, recipients and staff professionally. You may refuse an unsafe or unlawful instruction and should report it immediately.
5. Location and communications
During an active assignment, the driver app or approved tracker may transmit location, route, device and status data for dispatch, safety, ETA, fraud review and proof of service. Do not disable or falsify required tracking. Trip participants receive only the information needed for the trip, as described in the Privacy Notice.
6. POD, COD and custody
Proof-of-delivery codes, signatures and photographs must reflect the actual handover. A driver collecting cash-on-delivery holds it for the relevant logistics provider and must follow the stated handover process. It must not be spent, offset or mixed with personal money.
7. Earnings, deductions and allowances
The accepted offer or provider arrangement controls earnings. The ledger may show pending, held and available amounts. Lawful, disclosed deductions may include agreed fees, reversals, supported loss, chargebacks or unreconciled allowances. A trip allowance is restricted to approved trip costs and unused or unsupported amounts may be reversed after review.
8. Tax and insurance
Independent drivers and carriers are responsible for their own registrations, taxes, filings, insurance and business expenses unless law or a written provider agreement places responsibility elsewhere. FreightCMD does not provide tax advice or guarantee work, trip volume or income.
9. Disputes and suspension
Raise an earnings, deduction, cargo or conduct dispute with supporting records under the Complaints Policy. Access may be restricted for safety risks, expired documents, fraud, material breach or legal requirements. Active cargo must be protected and handed over as directed even when access is restricted.
10. Incorporation
The Terms & Conditions, Privacy Notice, Payments Disclosure, Acceptable Use Policy and applicable trip terms are incorporated into this agreement.
